3. Possess a good business reputation, with no administrative penalties, abnormal business operations, or untrustworthy records related to the tender project in the National Enterprise Credit Information Publicity System, or such records have already been removed; and have no record of misconduct in other tendering processes conducted by our company.
4. Bidders must be the ultimate winning bidder and enter into a contract; under no circumstances may they subcontract the awarded project to any other entity in any form.

Part Two Preparation of the Bid Document
I. Language of Bidding and Units of Measurement
1. Bidding documents prepared by the bidder, documents exchanged in connection with the bidding process, and all correspondence shall be written in Chinese.
2. Unless otherwise specified in the tender documents, all measurement units used in the tender documents shall be the statutory units of measurement of the People’s Republic of China.

3. Binding of the Bid Document
3.1 The tender documents shall be completed in the prescribed uniform format and bound into a volume.
3.2 The paper-based tender documents shall be submitted in two copies: one original and one duplicate.
4. Instructions for Preparing the Bid Document
The tender documents shall be prepared in accordance with the requirements, and no unauthorized deletion or reduction of content is permitted.
5. Bid Price
5.1 All bids shall be quoted in Renminbi. (RMB; both tax-inclusive and tax-exclusive prices shall be quoted, with the applicable tax rate clearly indicated.)
5.2 Bidders shall complete the quotation in accordance with the detailed specifications and quality requirements for the printed materials related to the tendered project, and the quotation must be signed by the legal representative or an authorized representative.

6. Signing and Provisions of the Tender Documents
6.1 Bidders shall provide their full legal name and affix the company seal.

Part Four Awarding the Contract
I. Notice of Winning Bid
1. The tendering entity shall determine the winning bidder based on the evaluation results submitted by the evaluation committee and issue a notice of award.

The winning bidder shall not sub-contract or further sub-contract the awarded project to any other party; otherwise, such act shall be deemed a breach of contract, and the tendering authority shall have the right to terminate the contract.

II. Cancellation of the Tender
1. If a bidder falls under any of the following circumstances, its bid shall be deemed invalid, and the procuring entity shall exercise its rights in strict accordance with the provisions of the Bidding and Tendering Law of the People’s Republic of China and other relevant laws, regulations, and rules. If the bidder causes losses to the procuring entity, the latter shall have the right to claim compensation, which the bidder shall promptly pay.
(1) Where fewer than three suppliers meet the eligibility criteria or provide a substantive response to the tender documents; where unlawful or non-compliant conduct that undermines the fairness of the procurement occurs; where the tender documents submitted by different bidders are unusually consistent or where there are systematic differences in bid prices; where all bids exceed the procurement budget; or where the procurement task is canceled due to significant unforeseen circumstances, among other such situations;
(2) During the entire bid evaluation process, the bidder engages in any activity intended to influence the impartiality of the evaluation results;
(3) Collusive bidding by bidders;
(4) The bidder has been reported or denounced, and the tendering entity has verified the allegations to be true;
(5) Bidding in another person’s name or engaging in other forms of fraud to fraudulently obtain the bid;
(6) Other circumstances as prescribed by laws and regulations.
2. Principles for Handling Deficiencies in the Winning Bidder That Are Discovered Subsequently: Regardless of the underlying reasons, if any circumstance that would ordinarily warrant rejection—whether due to failure to detect such circumstances in a timely manner or due to the winning bidder’s concealment of material facts—results in the winning bidder passing the qualification review, preliminary evaluation, on-site re-examination, final evaluation, or any other relevant procedures, including cases where the notice of award has already been issued or a contract has already been signed, the procuring entity shall have the right to reject the winning bidder or to disqualify it. Once the winning bidder is rejected or its previously awarded evaluation results are rescinded, all resulting losses shall be borne solely by the winning bidder.
3. The final interpretation of this tender shall be vested in China National Heavy Duty Truck Group Liuzhou Yunli Special-Purpose Vehicle Co., Ltd.
